The website https://www.myamericanmarket.com is operated under the trade name My American Market by SARL CLIC PHARMA, with a share capital of €1,000, registered under SIREN number 908 827 033 (RCS Marseille), EU VAT number FR67908827033, whose registered office is at 1 Rue Francis Davso, 13001 Marseille, France (hereinafter "the seller").

2. Purpose
These Terms and Conditions of Sale govern the sale of products on the My American Market website between the seller and any consumer customer. Placing an order implies full acceptance of these Terms and Conditions.
3. Products
The website offers imported food products, confectionery, non-alcoholic beverages and grocery products. Essential information (ingredients, allergens, best-before date, origin) is shown on the product pages.
Photographs are not contractual. Manufacturers may change packaging, recipes or sizes without notice. Customers are advised to read the list of ingredients and allergens on the packaging of the product received.
4. Prices
Prices are shown in euros, including all taxes (VAT included), excluding shipping costs. Shipping costs are shown before the order is confirmed and are detailed on the Shipping page. The price applied is the one displayed at the time of the order.
5. Orders
The order is final once payment has been confirmed. A confirmation email summarizing the order is sent to the customer. The seller may refuse an order in the event of fraud, an existing dispute, non-payment or any anomaly. The customer is responsible for the accuracy of the information provided (address, email, phone number).
6. Payment
Payment is due immediately when the order is placed. Accepted payment methods are:
- bank card (CB, Visa, Mastercard, American Express);
- PayPal, including Pay in 4 (subject to PayPal approval);
- Apple Pay and Google Pay;
- iDEAL and Bancontact.
Payments are secured by certified providers. No bank details are stored by the seller. More information on the Secure payment page.
7. Delivery
Products are delivered in France and in the European countries listed on the Shipping page, by the carriers offered when placing the order. Delivery times are indicative and may vary depending on the carrier, the period and the destination.
Risk passes to the customer when the customer, or a third party designated by them, takes physical possession of the parcel.
If a parcel is damaged, the customer must record precise reservations with the carrier or the pickup point upon receipt and take photos. If a parcel is lost or not received, the customer informs the seller, who opens an investigation with the carrier.
Parcels returned to the seller due to an incorrect address or because they were not collected may be reshipped at the customer's expense.
8. Right of withdrawal
The customer has 14 days from receipt of the order to exercise the right of withdrawal, without having to give a reason. The customer informs the seller of their decision with a clear statement, for example by sending the form below to contact@myamericanmarket.com.
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to:
- products that are liable to deteriorate or expire rapidly;
- products that have been unsealed by the customer after delivery and cannot be returned for health protection or hygiene reasons.
Products must be returned complete, unopened and in perfect condition, within 14 days of communicating the withdrawal decision. Return costs are borne by the customer.
The seller refunds all amounts paid, including the initial delivery costs (based on the cheapest standard delivery method), within 14 days of receiving the withdrawal request. The refund may be withheld until the returned products have been received or until proof of shipment is provided. The refund is made using the same payment method as the one used for the order.

9. Imported food products
Products may come from different countries and vary from one batch to another (taste, texture, packaging). These variations are not a defect.
Best-before dates are shown on the product pages or packaging. A product with a short best-before date cannot be the subject of a claim if that date was shown before purchase.
Heat-sensitive products (chocolates, confectionery) may change in appearance during transport without affecting whether they are fit to eat.
10. Claims
Any claim must be sent to contact@myamericanmarket.com with the order number and evidence (photos). Products that have been consumed are not refundable, except in the case of a hidden defect.
11. Legal warranties
The customer benefits from the legal warranty of conformity (Articles L217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).
Under the legal warranty of conformity, the customer has 2 years from delivery of the product to take action. The customer may request replacement of the product or, if this is impossible, a refund. Under the warranty against hidden defects, the customer may choose between cancellation of the sale and a price reduction.
12. Liability
The seller cannot be held liable for damage resulting from improper use or improper storage of the products by the customer, or from failure to follow the information on the packaging (ingredients, allergens, storage conditions).
13. Retention of title
Products remain the property of the seller until the order has been paid in full.
14. Personal data
Personal data is processed in accordance with the GDPR. To find out more, the customer can read the privacy policy or write to contact@myamericanmarket.com.
15. Force majeure
The seller cannot be held liable for failure to perform its obligations in the event of force majeure, within the meaning of Article 1218 of the French Civil Code.
16. Mediation
In the event of a dispute, the customer first sends a written complaint to the seller at contact@myamericanmarket.com. If no amicable solution is found, the customer may use a consumer mediator free of charge, whose details will be provided here.
17. Governing law
These Terms and Conditions of Sale are governed by French law. In the event of a dispute, the competent courts are determined in accordance with the French Code of Civil Procedure and the French Consumer Code.
18. Acceptance
Confirming the order constitutes acceptance of these Terms and Conditions of Sale.
